iServer Company Policies
A list of company policies is enumerated below. As an iServer
Customer or potential iServer Customer, please review and
become familiar with these policies. Should you have any
specific questions regarding these policies, please contact the
iServer Policy Department.
Billing and Collection Policies
- Resellers of iServer are responsible for collecting payments
from their own customers. Resellers are in turn responsible
for payment directly to iServer for the full amount of their
monthly bill. If a Resellers customer is delinquent with
payment to the Reseller, the Reseller may request a Server
to be disabled until payment is received.
- The Reseller agrees to pay a monthly Service Fee to iServer
for the services it provides according to the current iServer
Virtual Server Price Schedule. The Service Fee is billed to
you at the beginning of each month and is due no later than
the 20th day of the month in which the Service Fee is billed.
Your first month of service will be prorated according to the
number of days you had an active Server during the first month.
The Service Fee is subject to adjustment, with notice,
according to the current Virtual Server Price Schedule.
- If a Reseller requests termination of a Server(s), the Service
Fee is not pro-rated for the final month and the monthly fee is
still applicable. Please keep this in mind as you request a
Server to be terminated.
- Any reconciliation requests or disputes of charges that take
place, must be taken care of during the current billing cycle.
A Reseller forfeits the right to reconciliation of charges if the
request is more than 60 days past the invoice date in question.

Customer Support Policies
The iServer Support Team is largely responsible for supporting the
Resellers and their End-users by isolating specific problems that
may be encountered while using the iServer Virtual Server.
Realistically, the iServer Support Team cannot and will not focus
large amounts of time fulfilling programming specific cgi script
requests (this includes debugging). The iServer Support Team will
troubleshoot specific programming problems which may be encountered
insofar as they are related to installation and configuration in
the Virtual Server environment.
The iServer Support Team can offer recommendations and direct the
Reseller to the necessary resources which will allow them to create
what is necessary for their express purposes. Please keep in mind
that iServer offers technological expertise with the iServer Virtual
Server and does not participate as a web designer.
Also, iServer will not offer technical support for third party
vendor products that are outside of the existing iServer server
extensions. If you have such a problem which is not specific to
installing or running the program on a Virtual Server, please refer
your questions to the vendor of the program.
Reseller/Enduser Policies
Should an end user of an iServer Reseller request to become an
iServer Reseller, the end user is subject to the following:
- A new Reseller (previous end user) must order a new Server
with a new IP address and pay all applicable set-up fees for
the Server(s) and for any additional products the Server had
(i.e. CyberCash, SSL, etc).
- A new Reseller (previous end user) must order additional
Servers and IP addresses for any other Servers and virtually
sub-hosted accounts that may be involved, and pay the
applicable set up fees as though the accounts were being set
up for the first time, including sub-host charges.
- A new Reseller must close any accounts with their previous
Reseller according to the standard procedure for that
particular Reseller. The new Reseller should ensure that
their balance is paid in full to their previous Reseller.
Should the previous Reseller prove that there is an
outstanding balance, the Servers which have been ordered will
be placed on hold until the accounts have been paid in full.
Virtual Server Policies
Unsolicited E-mail Policy
Unsolicited e-mail or "spam" sent from an iServer account or
associated with an iServer account is not tolerated. This
INCLUDES any e-mail that promotes web sites hosted on an iServer
Virtual Server but is sent from an e-mail address not associated
with an iServer account.
Section 9 of the Service Agreement is included for your review:
- Use of distribution lists via unsolicited
electronic mail or other mass electronic mailings is
strictly prohibited. The Provider reserves the right
to deactivate the Client's Virtual Server account(s)
upon an indication of such activity.
After the first violation of this policy, we will give a warning
to the customer, or Reseller of the customer. Resellers are
responsible to forward any warnings we give concerning unsolicited
e-mail to their customers that send unsolicited e-mail. After the
second violation, the Server will be disabled without warning and
the account may be terminated.
Resellers should make this policy clear to their customers BEFORE
they order a Server. Please realize that because many Resellers
have sub-hosted clients on a single Virtual Server, disabling of a
Server will affect all clients on that Server. Therefore, it is
imperative that Resellers make this clear and seek to enforce any
infractions to this Policy immediately.
We believe strongly in promoting "netiquette", or proper use of the
Internet. A strong anti-spamming policy will benefit all of us by
establishing iServer and its Resellers as the leading sources of
Virtual Servers and web design services on the Internet.
Activities Subject to Immediate Deactivation
Any Virtual Server that is used for illegal, abusive, or unethical
activity may be immediately deactivated by us without warning to you.
Illegal, abusive or unethical activities may include, but are not
limited to, pornography, obscenity, nudity,
violations of privacy, hacking, computer virus,
gambling, or promotion of gambling, and
any harassing or harmful materials or uses as determined by us.
You agree to indemnify and hold us harmless from any claim resulting
from your publications or use of illegal, abusive, or unethical
materials. Although we will make reasonable effort to alert you to
such activities and allow you an opportunity to cure them within a
12-hour period after discovery, we are not required to give such notice
before deactivating your use of our services if, in our discretion,
your use is or results in illegal, abusive, or unethical activities.
If a Virtual Server is disabled, the regular monthly fees still apply
until the Virtual Server is terminated by the Reseller.
Resellers must keep in mind, if a sub-hosted account is deactivated
for any illegal, abusive, or unethical activity, all sub-hosted
accounts that are housed on the Server will be affected by the
deactivation.
